Pension Reform on Hold; AFSCME Readying for Court Battle

Wednesday’s ruling by a Sangamon County judge is a small victory for state workers, according to AFSCME Council 31 Executive Director Henry Bayer.

The pension overhaul law was set to go into effect June 1st and Bayer says the temporary injunction order will maintain the status quo.

“This is a important step forward. First of all, for our members, the people we represent. There has been much confusion and angst that this legislation has caused not knowing what decisions they might have to make in regards to their retirement, when they should retire” says Bayer.

Five lawsuits representing various employee groups were consolidated into one and now the court will be asked to rule on the law’s constitutionality. The law cannot take effect until that’s determined.

It is not clear whether the Illinois Attorney General’s Office will file an appeal.
